Note on the transfer of data to third countries that are not secure under data protection law and the transfer to US companies that are not DPF-certified
Among other things, we use tools from companies based in third countries that are not secure under data protection law and US tools whose providers are not certified under the EU-US Data Privacy Framework (DPF). We have concluded an order processing contract (AVV) with the company kultwerk GmbH, Hochmeisterstraße 3, 79104 Freiburg, a website agency. This is a contract prescribed by data protection law, which guarantees that the agency will only process the personal data of our website visitors in accordance with our instructions and in compliance with the GDPR.
In this contract, Kultwerk has contractually undertaken to commission subcontractors only under the condition of a contractual agreement in accordance with Art. 28 para. 2-4 GDPR. In application of this provision, Kultwerk has commissioned the newsletter service provider Inxmail as a subcontractor.
8. Plugins and tools
YouTube with extended data protection
This website embeds videos from the YouTube website. The operator of the website is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.
When you visit one of these websites on which YouTube is integrated, a connection to the YouTube servers is established. The YouTube server is informed which of our pages you have visited. We assure you that your data will be collected, processed, and used in accordance with applicable data protection law and all other statutory provisions and that your data will be treated in strict confidence.
Scope and purpose of data collection
If you send us an application, we process your associated personal data (e.g., contact and communication data, application documents, notes during interviews, etc.) insofar as this is necessary for the decision on the establishment of an employment relationship. The legal basis for this is § 26 BDSG under German law (initiation of an employment relationship), Art. 6 para. 1 lit. b GDPR (general contract initiation) and - if you have given your consent - Art. 6 para. 1 lit. a GDPR. Consent can be revoked at any time. Your personal data will only be passed on within our company to persons who participate in processing your application.
If the application is successful, the data submitted by you will be stored in our data processing systems based on § 26 BDSG and Art. 6 para. 1 lit. b GDPR for the purpose of implementing the employment relationship.
Data retention period
If we are unable to make you a job offer, you reject a job offer or withdraw your application, we reserve the right to retain the data you have submitted based on our legitimate interests (Art. 6 para. 1 lit. f GDPR) for up to 6 months from the end of the application process (rejection or withdrawal of the application).
The data will then be deleted, and the physical application documents destroyed. The retention serves as evidence in the event of a legal dispute. Koje se kategorije podataka upotrebljavaju i odakle potječu?
Kategorije osobnih podataka koji se obrađuju tijekom postupka prijave (osobni podaci koji se mogu povezati s Vama) uključuju, osobito, Vaše matične podatke (kao što su ime, prezime, sufiks imena), podatke o kontaktu (privatna adresa, mobilni/telefonski broj, adresa e-pošte) koje nam dostavite (npr. U koju svrhu i na kojem pravnom temelju se obrađuju moji podaci?
Obrađujemo Vaše osobne podatke na temelju odredbi Opće uredbe EU o zaštiti podataka (DS-GVO), zakona o zaštiti podataka i svih ostalih relevantnih zakona (npr. zakon o godišnjem odmoru, zakon o radnom vremenu, opći zakon o ravnopravnosti). Svrha obrade podataka je provođenje i realizacija postupka prijave i procjenjivanje prikladnosti za određeni posao. Obrada Vaših podataka podnositelja zahtjeva je neophodna kako bi se mogla donijeti odluka o zasnivanju radnog odnosa. Primarna pravna osnova za to je članak 6. stavak 1. točka b) DS-GVO. Osim toga, pristanak se sukladno članku 6. stavak 1. točka a), 7 DS-GVO može koristiti kao dozvola u smislu zakona o zaštiti podataka.
U pojedinim slučajevima obrađujemo Vaše podatke, ali samo nakon njihove anonimizacije, kako bismo zaštitili naše legitimne interese. Tako se eventualno obrada podataka vrši isključivo u statističke svrhe (npr. provere ponašanja kandidata). Sastavljanje takvih statistika obavlja se isključivo za vlastite potrebe i nikada se ne vrši personalizirano, već anonimizirano. Tko dobiva Vaše podatke?
Unutar naše grupe tvrtki svoje osobne podatke dobivaju samo osobe i tijela kojima su ti podaci potrebni u kontekstu postupka prijave i s tim povezanih zakonskih i (pred)ugovornih obveza. Unutar naše grupe tvrtki Vaši se podaci prenose određenim tvrtkama ako centralno obavljaju zadatke obrade podataka za tvrtke u grupi (npr. upravljanje prijavama za posao na razini cijelog poduzeća). Koja prava zaštite podataka mogu ostvariti kao pogođena osoba?
Prema članku 15. DS-GVO možete zatražiti informacije o podacima pohranjenima o Vama. Osim toga, sukladno čl. 16., čl. 17. i čl. 18. DS-GVO pod određenim uvjetima možete zahtijevati ispravak, brisanje i ograničenje obrade Vaših podataka. Prema čl. 20 DS-GVO možete imati pravo na dobivanje podataka koje ste stavili na raspolaganje, i to u strukturiranom, uobičajenom i strojno čitljivom formatu. Ako obrađujemo Vaše podatke kako bismo zaštitili legitimne interese (članak 6, stavak1 e i f), možete proturječiti ovoj obradi u skladu s čl. 21. DS-GVO. Koliko će moji podaci biti pohranjeni?
Izbrisat ćemo Vaše osobne podatke 6 mjeseci nakon završetka postupka prijave. Ovo se ne primjenjuje ukoliko zakonske odredbe sprječavaju brisanje ili je daljnje pohranjivanje potrebno radi pružanja dokaza. Ako je radni odnos zasnovan, preuzet ćemo Vaše podatke u naše digitalne sustave upravljanja ljudskim resursima.
Postoji li obveza da stavljate podatke na raspolaganje?
U sklopu Vaše prijave upućeni smo na stavljanje na raspolaganje osobnih podataka potrebnih za provođenje postupka prijave i procjene prikladnosti za posao. Bez tih podataka nećemo moći provesti postupak prijave i donijeti odluku o zasnivanju radnog odnosa.
Do koje mjere dolazi do automatiziranih odluka u konkretnim slučajevima ili do mjera profiliranja?
U konkretnom slučaju koristimo automatizirane procese obrade i/ili profiliranje kako bismo pomogli pri donošenju odluke u postupku prijave. U tim slučajevima prethodno dolazi do posebne obavijesti prema članku 13 st. 2 f DS-GVO.

3. Processing purposes and legal bases
The personal data we collect from suppliers and other business partners and interested parties is used exclusively for the purpose of initiating, establishing and processing contractual and delivery relationships, including delivery and payment. The personal data collected from you is necessary for the conclusion and processing of a contract or payment of a claim. You are not obliged to provide this data, but without this data we cannot conclude a contract with you or make a payment to you.
In this respect, the processing of your data takes place on the basis of Art. 6 Para. 1 Letter b or c GDPR.
Your personal data will not be processed for advertising purposes.
4. Categories of personal data processed by us
The personal data is collected in the context of our customers and business relationships. In addition, we process the personal data entered into our systems by the contact persons of their companies. The following data can be processed:

Svrha i pravni temelji obrade podataka
Obrađujemo Vaše osobne podatke u skladu s Općom uredbom o zaštiti podataka (GDPR) i svim drugim primjenjivim zakonima.
Vaši podaci će biti podrška trgovcu, informacija o osiguranju ili jamstvenih programa, priprema marketinških aktivnosti u obliku programa kontakta s kupcima ili jamstvenih programa. Podaci o šteti potrebni su nam, primjerice, za provjeru je li nastupio slučaj osiguranja i kolika je šteta.
Sklapanje odn. izvršavanje ugovora o osiguranju (npr. ugovor o poslovnoj suradnji za grupu jamstvenih ugovora ili sporazum o jamstvenom servisu) nije moguće bez obrade Vaših osobnih podataka.
Usto trebamo Vaše osobne podatke za izradu statistika specifičnih za osiguranje, npr. za razvoj novih tarifa ili ispunjavanje pravnih propisa nadzora.
Pravni temelj za ove obrade osobnih podataka u predugovorne i ugovorne svrhe je čl. 6. st. 1.b) Opće uredbe o zaštiti podataka.
Vaše podatke također obrađujemo da bismo zaštitili svoje legitimne interese i legitimne interese trećih strana (čl. 6. st. 1. f) Opće uredbe o zaštiti podataka). To može biti posebice nužno:
- za osiguranje IT sigurnosti i IT operacija,
- za reklamiranje vlastitih osigurateljnih proizvoda,

U ovom su slučaju pravni temelj za obradu dotični zakonski propisi u vezi s čl. 6. st. 1. c) Opće uredbe o zaštiti podataka.
Namjeravamo li obrađivati Vaše osobne podatke u neku svrhu koja nije prethodno navedena, o tome ćemo Vas informirati u okviru zakonskih odredbi.

Rizike koje preuzmemo osiguravamo kod specifičnih osiguravateljskih kuća (prodavatelj osiguranja). U tom kontekstu može biti potrebno proslijediti Vaše ugovorne podatke i eventualno podatke o šteti prodavatelju osiguranja kako bi isti imao sliku o riziku ili slučaju osiguranja.
Proizvođači/uvoznici vozila:
U sklopu jamstvenih ili osigurateljnih programa koji su dogovoreni s proizvođačima odn. uvoznicima vozila Vaši se ugovorni podaci i po potrebi podaci o šteti prosljeđuju proizvođačima odn. uvoznicima vozila, primjerice radi izrade statistika.

Vaše osobne podatke također možemo priopćavati drugim primateljima, primjerice javnim tijelima radi ispunjavanja zakonskih obveza obavješćivanja (npr. poreznim tijelima ili tijelima za kazneno gonjenje).
Trajanje čuvanja podataka
Vaše osobne podatke brišemo čim više nisu potrebni u gore navedene svrhe. Osim toga, moguće je da se osobni podaci čuvaju u razdoblju u kojem se protiv našeg trgovačkog društva mogu ostvariti zahtjevi (zakonski rok zastare od tri ili do trideset godina). Usto čuvamo Vaše osobne podatke toliko dugo koliko smo obvezani zakonom. Odgovarajuće obveze dokazivanja i čuvanja proizlaze između ostaloga iz njemačkih zakona iz područja pranja novca, trgovačkog i poreznog prava. Rokovi za čuvanje sukladno s tim propisima iznose do deset godina.

O svojoj obvezi isplate djelomično donosimo potpuno automatizirane odluke na temelju Vaših navoda o slučaju osiguranja ili štete, podataka koji su pohranjeni za Vaš ugovor i eventualno informacija trećih osoba koje smo primili na tu temu. Potpuno automatizirane odluke temelje se na unaprijed utvrđenim pravilima poduzeća o vrednovanju informacija.
